1agreement

These terms are a contract between you and Runners High Group Limited, an Ontario company ("jellybean", "we", "us"). By creating an account you agree to them, to our privacy policy and to our community guidelines. If you do not agree, do not use jellybean.

2who can use jellybean

• You must be at least 18 years old.
• You must sign in with your own Apple ID and keep only one account.
• You can browse runs after signing in. Before you can join or post a run, or start or join a jar (a run that repeats at the same start point and time every week), you must buy the Starter (see section 6) and pass an ID check through our provider Stripe: a photo of your own valid government ID and a live selfie. Using someone else's ID, or a fake one, is not allowed.
• You must not use jellybean if we have banned you before, or if you are prohibited by a court order from contacting anyone you might meet.
• jellybean currently serves Toronto. You may download it elsewhere, but runs are only posted in the areas we have opened.

3what jellybean is, and what it is not

jellybean is a place to post and find group runs. We provide the listings, the join and credit system, verification tools, reporting and blocking.

We do not organise, lead, supervise or attend runs. Runs are posted by members. We do not check routes, weather, traffic, fitness levels or the conduct of members beyond the checks described in our privacy policy. ID verification confirms that a document looked genuine, matched a live selfie and showed an age of 18 or older, at one moment. It does not tell you anything about a person's character, criminal history or intentions, and we do not check criminal records.

4your risks and your choices

Running and meeting people you do not know both carry risk, including injury, illness, and harm caused by other people. You decide whether to post, join, attend or leave a run, and you are responsible for your own fitness and conduct. Read our community guidelines for practical advice. If you are in danger, call 911 first, then report it to us.

You agree that you take part in runs voluntarily and at your own risk, to the extent the law allows.

5women-only runs

Members who are eligible can post runs and jars as women-only. Only eligible members can see and join them; everyone else sees mixed runs. You are eligible automatically if the sex marker on your verified ID reads female. If it does not and you are a woman, you can ask for a review by a person at jellybean. See our privacy policy, section 4. Women-only runs exist to help women who would not otherwise run with strangers feel able to take part. Trying to get around eligibility (for example by using someone else's ID) is a serious breach of these terms and will lead to a permanent ban.

6credits, purchases and subscription

Credits.

• You spend 1 credit to join a run, and 1 credit for each jar run you join. Joining a jar itself is free. When you host a run and at least one person is marked present at the end, you earn 1 credit, at most 1 earned credit per day. The exact amounts are shown in the app and may change; changes do not affect credits you already have.
• Credits have no cash value, cannot be sold, transferred or exchanged for money, and do not expire.
• If a run is cancelled by its poster, joiners get their credit back. If you cancel your own join before the start time, you get your credit back.
• Your balance never goes below zero.
• If you delete your account, or we close it for breaking these terms, unused credits are lost, including credits you paid for, and we cannot move them to another account. If we shut jellybean down, we will give at least 30 days' notice.

Purchases.

• All purchases in jellybean are Apple in-app purchases, charged to your Apple ID account. We never see or store your card details.
• Starter (US$3.99, or the local price Apple shows you): a one-time purchase per account. It pays for your ID check, which is what it costs for every member to be verified, and adds 10 credits (10 runs). It can be bought only once per account.
• Credit packs (consumable): 8 credits for US$3.99, 20 credits for US$7.99, 45 credits for US$14.99, or the local prices Apple shows you. Packs pay for members' ID checks and for running the service. Credits are added to your balance when Apple confirms the purchase.
• The Starter and credit packs are consumable: they are used up when the credits are added, and they cannot be restored on another device or account.
• Prices may change. The price shown in the App Store at the time you buy is the price you pay.

jellybean Unlimited (auto-renewing subscription).

• jellybean Unlimited is a monthly subscription, US$5.99 per month or the local price Apple shows you. While it is active, joining runs and jar runs costs 0 credits. Like packs, it pays for members' ID checks and for running the service.
• Payment is charged to your Apple ID account when you confirm the purchase.
• The subscription renews automatically each month unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for the renewal within 24 hours before the end of the current period, at the then-current price.
• You can manage or cancel the subscription in your Apple ID account settings after purchase (on iPhone: Settings, your name, Subscriptions). Cancelling stops the next renewal; you keep jellybean Unlimited until the end of the period you paid for.
• Deleting the app or your jellybean account does not cancel the subscription. Cancel it with Apple.

Refunds.

• Apple handles all payments, so refund requests go to Apple at reportaproblem.apple.com. We cannot issue refunds ourselves.
• If your ID check fails, or shows you are under 18, you cannot use the Starter, and you can ask Apple for a refund of it.
• If Apple refunds a Starter or credit pack, we remove the unspent credits from that purchase. Your balance never goes below zero because of this.
• Nothing here limits refund rights you have under consumer protection law.

Always free. Women-only runs, reporting, blocking and check-in are never behind a purchase or the subscription.

7your content

You keep ownership of what you post (run descriptions, jar names and descriptions, reports). You give us a non-exclusive, worldwide, royalty-free licence to host, show and process it so jellybean works, for as long as it is on jellybean. Do not post anything that identifies you or anyone else (names, handles, phone numbers, photos), anything unlawful, or anything that breaks the community guidelines. We may remove content and we filter some words automatically.

8rules

You must follow the community guidelines. In particular you must not: harass, threaten or follow anyone; try to find out who another member is; use jellybean to look for romantic or sexual partners, to sell, to recruit, or for anything other than running together; create fake or duplicate accounts; use someone else's ID; manipulate credits or attendance marks; scrape, reverse engineer or interfere with the app.

9suspension and removal

We may warn, suspend or ban an account, remove content, or limit features if we reasonably believe someone broke these terms or the guidelines, or to protect members or the public. Repeatedly joining runs and not turning up can lead to a suspension. Unless telling you would put someone at risk, we will tell you why and give you a way to ask for a review. You can delete your account at any time in the app; this also revokes jellybean's access to your Apple ID.

10third-party services

jellybean uses Apple (Sign in with Apple, notifications, in-app purchases and subscriptions) and Stripe (ID and selfie verification). Their terms apply to your use of them. Apple is not responsible for jellybean or its content.

11disclaimers

jellybean is provided "as is". We do not promise that it will always be available, that listings are accurate, or that members are who they say they are or will behave well. Nothing in these terms removes rights you have under consumer protection law that cannot be removed.

12limitation of liability

To the extent the law allows, we are not liable for indirect or consequential losses, or for the acts or omissions of other members, and our total liability to you for any claim is limited to CA$100. This does not limit liability for death or personal injury caused by our negligence, fraud, or anything else that cannot be limited by law.

13indemnity

If you break these terms or the law and someone makes a claim against us because of it, you will cover our reasonable costs of that claim, to the extent the law allows.

14disputes and governing law

These terms are governed by the laws of Ontario and the federal laws of Canada that apply there. Please contact us first so we can try to fix things. If we cannot, either of us may bring a claim in the courts of Ontario, including Small Claims Court. If you live in another province, you may also have rights to bring a claim where you live.

15changes

We may update these terms. If a change matters, we will tell you in the app at least 14 days before it takes effect. If you keep using jellybean after that, the new terms apply. If you do not agree, delete your account.
